  • Definitions
  1. Customer – a natural person, legal person or organizational unit that is not a legal person, the specific provisions of which grant legal capacity, which places an Order in the Store.
  2. Civil Code – the Act of April 23, 1964. (Journal of Laws 1964 No. 16, item 93, as amended).
  3. Regulations – these Regulations for the provision of electronic services as part of the online store www.grupablue.pl.
  4. Online Store – the website available at www.grupablue.pl, through which the Customer may, in particular, place Orders;
  5. Services – services presented in the Online Store.
  6. Service Provider – Blue energy sp. z o. o. with its seat in Poznań (61-896) at ul. Towarowa 35, registered in the Register of Entrepreneurs of the National Court Register kept by the District Court Poznań – Nowe Miasto and Wilda in Poznań, 8th Commercial Division of the National Court Register, under KRS number: 0000361608, with share capital in the amount of PLN 65,000, NIP: 7781473428, REGON: 301493828 .
  7. Agreement – an agreement for the provision of services within the meaning of the Civil Code, concluded between the Service Provider and the Customer, concluded using the Online Store.
  8. Order – Customer’s declaration of intent, aimed directly at the conclusion of the Agreement, specifying in particular the type and number of Services.
  • General provisions
  1. These Regulations define the rules for using the online store available at www.grupablue.pl and run by the Service Provider.
  2. These Regulations define in particular:
    1. types and scope of services provided electronically;
    2. conditions for the provision of electronic services;
    3. conditions for concluding and terminating contracts for the provision of electronic services,
    4. complaint procedure.
  • Rules for using the online store
  1. The purchase of the Service does not require registration in the Online Store.
  2. The information provided in the Online Store, including information about the services presented, in particular their descriptions, technical and performance parameters and prices, constitute an invitation to conclude a contract, within the meaning of art. 71 of the Civil Code.
  3. Placing an order is done using the form available on the store’s website.
  4. Each customer who registers and / or places an order agrees to receive, to the e-mail address provided by him, information related to his invitation to conclude a contract, the course of the transaction, the status of the order and changes to these Regulations.
  5. In order to ensure the security of the transmission of messages and data in connection with the services provided as part of the online store, the Service Provider takes technical and organizational measures appropriate to the degree of threat to the security of the services provided, in particular measures to prevent the acquisition and modification of personal data sent on the Internet by unauthorized persons.
  6. It is prohibited for users of the Online Store to provide illegal content.
  • Types and scope of services available in the online store

  2. The detailed scope and date of the service is determined through consultations between the Customer and Blue energy Sp. z o. o
  • Procedure for concluding a contract for the provision of services
  1. In order to carry out any activity of the Customer in the Store, proper operation of the Internet is required, the use of a web browser installed on a desktop computer or a mobile device and an active e-mail account.
  2. In order to conclude the Agreement via the Online Store, go to the website www.grupablue.pl, make a choice, taking further technical steps based on the messages displayed to the Customer and information available on the website.
  3. The store allows you to purchase services 24 hours a day, 7 days a week.
  4. The selection of the Services ordered by the Customer is made by adding them to the basket.
  5. When placing an Order – until the button “Place an order” is pressed – the Customer may modify the entered data and the choice of Service. To do this, follow the displayed messages and information available on the website.
  6. To complete the order, the customer is asked to provide all the necessary data needed to complete the order, i.e.
    1. first name and last name
    2. company name
    3. NIP (tax identification number)
    4. address of the place of business
    5. e-mail adress
    6. phone number
  7. After the Customer using the Online Store provides all the necessary data, a summary of the placed Order will be displayed. The summary of the placed Order will contain information on:
    1. the subject of the contract,
    2. unit and total price of the services ordered, including additional costs (if any),
    3. the payment method depends on the service or software you are purchasing.
  8. In order to place an Order, it is necessary to accept the content of the Regulations, provide personal data marked as mandatory and press the “Place an order” button.
  9. Sending the Order by the Customer is a declaration of will to conclude an Agreement with the Service Provider, in accordance with the Regulations.
  10. After submitting and paying for the Order, the Customer receives an e-mail entitled “Order Confirmation” containing the final confirmation of all essential elements of the Order.
  11. The contract is considered concluded at the moment the Customer receives the e-mail referred to above.
  12. The contract is concluded in Polish, with the content in accordance with the Regulations.
  • Withdrawal from the contract
  1. In the cases referred to in the Act of 30 May 2014. on consumer rights (i.e. Journal of Laws of 2020, item 287, as amended), a consumer or a natural person concluding a contract directly related to their business activity, when the content of the contract shows that it does not have a professional nature for that person. the right to withdraw from a distance contract within 14 days from the date of its conclusion.
  2. In order to withdraw from the contract, the persons referred to in sec. the preceding ones should submit a declaration of withdrawal from the contract and send it to the e-mail address: biuro@grupablue.pl
  3. The right to withdraw from the contract is not due after the Service Provider has performed the service.
  • Complaints procedure
  1. In the event of irregularities in the operation of the Online Store or discrepancies between the rules for the provision of Services and the content of the Agreement, the Customer has the right to submit a complaint, which should be sent to the address biuro@grupablue.pl.
  2. The Service Provider considers the complaint within 14 days from the date of receipt by the Store of the complaint containing the full scope of information necessary for its consideration.
  • Principles of personal data processing
  1. The administrator of your personal data is Blue Energy limited liability company with its registered office in Poznań (61-896), at ul. Towarowa 35, entered into the Register of Entrepreneurs of the National Court Register kept by the District Court Poznań – Nowe Miasto and Wilda in Poznań, VIII Commercial Division of the National Court Register, under KRS number: 0000361608, NIP: 7781473428, REGON: 301493828, with share capital in the amount of 65,000 PLN (hereinafter referred to as the Administrator or the Company).
  2. In all matters related to the protection of your personal data, you can contact the Company by letter to the address of its registered office indicated above or via e-mail to the following address: ODO@grupablue.pl.
  3. Your personal data will be processed for the purpose of:
  4. conclusion of the contract and its implementation, and the legal basis for the processing of their processing is GDPR Art. 6 sec. 1 lit. b).
  5. ensuring communication between the parties and the legal basis for their processing is the legitimate interest pursued by the Administrator Art. 6 sec. 1 lit. f) GDPR
  6. debt collection and the legal basis for their processing is the legitimate interest pursued by the Administrator Art. 6 sec. 1 lit. f) GDPR
  7. fulfillment of legal requirements in the area of accounting and the legal basis for their processing is Art. paragraph 1 lit. c) GDPR.
  8. Your personal data will be kept for the period of: cooperation between Blue Energy and you, limitation of claims arising therefrom in accordance with the provisions of the Act of 23 April 1964. The Civil Code and the duration of legal obligations imposed on the Company, in particular on the basis of the Act of September 29, 1994. about accounting.
  9. Your personal data may be transferred to the following recipients:
      1. IT system suppliers with whom the Administrator cooperates in order to maintain the continuity and correct operation of IT systems;
      2. the company’s associates and law firms;
      3. entities operating postal or courier for the purpose of delivering correspondence;
      4. You have the right to access your personal data, the right to rectify it, delete it, limit processing, the right to transfer data and the right to object to their further processing.
      5. You also have the right to lodge a complaint with the President of the Personal Data Protection Office if you believe that the processing of your personal data violates the provisions on the protection of personal data.
      6. Providing your personal data by you is voluntary, but necessary for the conclusion and performance of the contract with Blue Energy.
      7. Your personal data will not be transferred to third countries or international organizations, and automated decision making, including profiling, will not be applied to you.
